·         The Emergency Medical Treatment and Active Labor Act

·         Is a federal law that was passed to ensure all patients presenting the EDs are:

o   Provided with an appropriate medical screening exam (MSE)

o    Provided treatment required to stabilize any unstable medical condition

o   Stabilization implies: patients should NOT be likely to deteriorate during transfer or as a result of a transfer and patients in active labor must be kept until the placenta is delivered


·         IF the patient does not have an Emergency Medical Condition, the hospital is under no further obligation to the patient to provide emergency care

·         Hospitals are NOT allowed to determine if the patient is able to pay for their care before providing a MSE and stabilizing any emergency medical conditions

·         Patients in active labor are covered under this statute

·         EMTALA is commonly referred to as the “anti-dumping” law, as it does not allow hospitals to
